As the data controller, we process your personal data (hereinafter referred to as the “controller” or “we”).

What Personal Data We Process
Personal Data You Provide to Us

We process personal data that you provide to us yourself.

If, for example, you order goods or services from us, we need the information marked as mandatory during the ordering process (primarily your first and last name and delivery address). Without this information, we would not be able to deliver the goods correctly. For the purpose of selling goods or services, we also need your e-mail address, to which we will send an order confirmation, which also serves as confirmation of the concluded purchase agreement, as well as a copy of the terms and conditions.

When ordering goods or services, you may also provide optional information. This helps us fulfil the concluded agreement better and more efficiently. For example, if you provide your telephone number, we may send you information about the delivery of your goods, etc. You provide optional information voluntarily.

After your goods have been delivered, you may receive an e-mail asking you to rate the purchased goods.

If you contact our customer service line or send us a message, we will also process the personal data contained in that communication.

By filling in optional information in your user profile, you may also provide us with other personal data, such as frequently used delivery addresses.

When paying by card from a mobile phone or computer, you will be redirected to the secure server of the payment gateway. Your payment card details are therefore not sent to our company but are transferred directly to our payment gateway provider through a secure connection. The payment gateway then transfers the data required to process the payment to the relevant banking institution, again through a secure data transfer.

Personal Data We Obtain Other Than Directly From You

As part of joint marketing campaigns, we may also process your personal data. We may combine such data for the purposes of marketing campaigns or for the proper fulfilment of a contract.

If your personal data is transferred to another entity, we will inform you in advance, including information about the recipient of the personal data. If someone provides us with your personal data, they must also inform you in advance.

Personal Data of Third Parties You Provide to Us

If you provide us with personal data of third parties, you are obliged to inform the relevant person and obtain their consent to these personal data protection terms.

For example, you may purchase goods from us but not wish to collect or make a warranty claim for them yourself. By e-mail or telephone, you may designate authorised persons who are entitled to collect goods or make a warranty claim on your behalf. In doing so, you also provide us with their personal data.

What Is a Cookie?

A cookie is essentially a small text file created when you visit a website. It is used as a standard tool for storing information about how our websites are used.

This allows us to distinguish (but not identify) individual users from one another and adapt content to their specific preferences. Cookies are important. Without them, browsing the website would be much more complicated.

Cookies serve several purposes. We use the following cookies on our online store:

Technical cookies: These cookies are necessary for proper operation, security, correct display on a computer or mobile device, functioning completion and submission of forms, and similar functions.

Audience measurement: these cookies allow us to optimise our website for your convenient use based on how you use it. The aim is to remember or anticipate your choices. This includes, for example, the use and placement of functions and behaviour on the website.

How You Can Control Which of Your Cookies We Process

You can use any common internet browser (e.g. Internet Explorer, Safari, Firefox or Chrome) with private browsing enabled, which prevents information about visited websites from being stored. Alternatively, you can completely disable cookie storage in your browser. However, if you also disable the processing of technical cookies, some functions that help you use the website will no longer work.

You can easily control our processing of statistical cookies by using this Google add-on (it can only be launched from a computer). However, disabling statistical cookies will significantly limit our ability to improve our online store.

Why We Collect and Process Your Personal Data
We Process Your Personal Data for the Following Reasons:

Purchase of goods and services: first and foremost, we process your personal data so that we can properly process and deliver your order. If any problems arise, your personal data allows us to know who to contact.

Customer care: if you contact us with a question or problem, we need to process your data in order to answer or resolve it. In some cases, personal data may also be transferred to third parties (e.g. the carrier delivering the goods or a service centre).

User account: the personal data you provide in your user profile gives you access to a number of useful functions (for example, if you provide your telephone number, we can easily inform you when your order will be delivered). You can change the information you provide at any time, with the exception of the e-mail address used to access your user account.

Marketing activities:

- E-mail marketing: we send commercial e-mail communications based on your consent. You can easily unsubscribe from commercial communications by clicking the unsubscribe link in the footer of the commercial communication, by e-mailing info@sfcb.cz or by calling our helpline at 602 405 290.

- Marketing competitions: in some cases, the winner of a competition may be photographed or filmed, primarily to increase the transparency of our marketing competitions. We process personal data for this purpose on the basis of our legitimate interest, which consists of increasing the credibility of marketing competitions in the eyes of other participants and increasing the attractiveness of these competitions.

- Retargeting: in some cases, we use retargeting techniques. You have the right to refuse retargeting by clicking this link and selecting the relevant option.

Improving our services: using your order history and behaviour on our website, we can offer more relevant recommendations for additional goods, such as accessories for purchased products. In certain areas, we therefore display products that are specifically relevant to you and correspond to your needs and interests. We also use tools such as Google Analytics, Facebook Analytics and similar tools to optimise elements on and outside our website (personalised advertising on third-party websites).

Customer reviews of goods and services: after you purchase goods or services from us, you may be asked to rate them. You may also submit a review on your own initiative.

Exercising rights and legal claims and inspections by public authorities: we may also process your personal data because we need it to exercise our rights and legal claims (e.g. if you have an outstanding debt towards us or to prove delivery of ordered goods). We may also process your personal data because it is necessary for inspections carried out by public authorities and for other similarly serious reasons.

Legal Grounds for Processing Personal Data
Performance and Conclusion of a Contract

We need a large part of your personal data in order to enter into a purchase agreement or another agreement with you concerning the goods or services you wish to purchase from us. Once the agreement has been concluded, we process your personal data so that we can properly deliver the purchased goods or provide the purchased services. On this legal basis, we primarily process billing and delivery information.

Legitimate Interests

We also use your personal data to provide you with relevant content, i.e. content that is of interest to you. On the basis of legitimate interest, we process in particular personal data that is processed automatically and cookies.

On the same legal basis, we may send e-mail or SMS messages to our customers.

Consent

For the purpose of sending commercial communications (e-mail marketing), we process your personal data on the basis of your consent. If you do not give us your consent and you are our customer, we may also send you commercial communications without your consent. In any case, you can easily unsubscribe from such marketing communications by clicking the unsubscribe link in the footer of the commercial communication, by e-mailing info@sfcb.cz or by calling our helpline at 602 405 290.

Transfer of Personal Data to Third Parties

We transfer your personal data to third parties in the following cases (in relation to this personal data, we act as the data controller):

Delivery of goods: the carrier you choose would never be able to deliver your ordered goods unless we provided it, among other things, with information about where and to whom the goods should be delivered. We provide the carrier with the information you enter in your order. Such information primarily includes your first and last name, delivery address, telephone number at which the carrier can contact you, and, if the goods have not been paid for in advance, the amount to be paid upon delivery. The carrier may process the personal data we provide only for the purpose of delivering the goods and must then delete the personal data without undue delay.

Payment cards: our company does not have access to the payment card details you use to pay for your purchases. Your payment card details are held only by the secure payment gateway and the relevant banking institution.

Commercial communications: when sending commercial communications (e.g. by e-mail or SMS), we may use a third party to distribute them. This third party is bound by a duty of confidentiality and may not use your personal data for any other purpose.

Product or service reviews through Heureka.cz or Zboží.cz: when sending purchase review questionnaires, your data (e-mail address, information about purchased goods/services) may be shared with the operator of the Heureka.cz portal (Heureka Group a.s.) or Zboží.cz (Seznam.cz, a.s.).
Pursuant to Section 7(3) of Act No. 480/2004 Coll., on certain information society services and on amendments to certain acts, as amended, we may send our customers marketing communications concerning our services or information about our company. You may object to receiving e-mail questionnaires through the Zboží.cz service or the Verified by Customers programme at any time, either directly in the shopping cart or by clicking the link in the e-mail containing the questionnaire. If you object, we will no longer send you the questionnaire.

State authorities: when enforcing our rights, your personal data may be transferred to a third party (e.g. a lawyer). If the law or a public authority (e.g. the Police of the Czech Republic) requires us to provide your personal data, we must do so.

Complaints and claims: to speed up and make the processing of your complaint or claim more efficient, our complaints department may need additional information about the defect, its manifestations or other relevant information. For this purpose, we provide the complaints department with the information you provided when submitting your complaint or claim (primarily your first and last name, address, telephone number and e-mail).

How Long Do We Process Your Personal Data?

First and foremost, we will process your data for the entire duration of our contractual relationship.

Where personal data is processed on the basis of consent, your personal data will generally be processed for 10 years or until such consent is withdrawn. If you subscribe to commercial communications, we will process your personal data for 10 years or until you object to receiving further communications. You can easily unsubscribe by clicking the unsubscribe link in the footer of the commercial communication, by e-mailing info@sfcb.cz or by calling our helpline at 602 405 290.

We also point out that personal data necessary for the proper provision of services or fulfilment of all our obligations, whether these obligations arise from our agreement with you or from generally binding legal regulations, must be processed regardless of your consent for the period prescribed by the relevant legal regulations or in accordance with them (e.g. for tax documents, this period is at least 10 years).

Data obtained through your user account is processed for as long as you use our services. Subsequently, only basic identification data and information about why the user account was cancelled, or data forming part of operational backups, are usually stored for a reasonable period.

Cookies: cookies containing information about user behaviour are deleted after 30 days, while older data is available in anonymised form in Google Analytics.

Security of Personal Data

Your personal data is safe with us. To prevent unauthorised access to and misuse of your personal data, we have implemented appropriate technical and organisational measures.

All communication between your device and our web servers is encrypted. Login credentials are hashed and all your data is stored only on servers in secure data centres with restricted, carefully controlled and audited access.

We strive to use security measures that provide sufficient protection in view of the current state of technology. The security measures adopted are regularly updated.

Personal Data of Persons Under 16

Our online store is not intended for children under the age of 16. A person under the age of 16 may use our online store only if consent has been given by their legal representative (parent or guardian).

What Rights Do You Have in Relation to the Protection of Your Personal Data?

In relation to your personal data, you have in particular the right to withdraw your consent to the processing of personal data at any time, the right to correct or supplement your personal data, the right to request restriction of its processing, the right to object to or lodge a complaint against the processing of your personal data, the right to access your personal data, the right to request the portability of your personal data, the right to be informed of a personal data security breach and, under certain conditions, the right to erasure of certain personal data that we process in relation to you (the so-called “right to be forgotten”).

Modification and Supplementation

You have control over your personal data primarily through your user account. You can delete or change basic information about yourself and similar information there.

Alternatively, you can contact us by e-mail or telephone.

Correction

If you believe that the personal data we process about you is incorrect, you can contact us by e-mail or telephone. However, to speed up the correction of your personal data and for your convenience, we recommend updating your personal data in your user profile.

Pursuant to the amendment to Act No. 235/2004 Coll., on Value Added Tax, data on an invoice that has already been issued cannot be changed from 1 January 2013. Invoice data may only be changed if you have not yet received and paid for the goods.

Access (Portability)

You can ask us to provide you with an overview of your personal data. Please contact us by e-mail or telephone.

You also have the right to access the following information concerning your personal data:

- What the purposes of processing your personal data are

- What categories of personal data are concerned

- Who, apart from us, the recipients of your personal data are

- The planned period for which your personal data will be stored

- Whether you have the right to request that we correct or erase your personal data, restrict its processing or object to such processing

- Information about the source of the personal data if we did not obtain it from you

Erasure

You may also request that we erase your data (however, erasure does not affect data contained in documents that we are legally required to retain, such as invoices or credit notes). If we need your personal data to establish, exercise or defend our legal claims, your request may be refused (e.g. if we have an outstanding claim against you or if a complaint or claims procedure is ongoing).

Please note that your payment card information is not stored by our company when paying without saving the payment card, but by the payment gateway provider (a third party). Therefore, we cannot erase this data ourselves and you must contact the payment gateway through which you made the payment.

Except in the cases mentioned above, you have the right to erasure in the following cases:

- The personal data is no longer necessary for the purposes for which it was processed

- You have withdrawn your consent on which the processing was based and there is no other legal ground for processing

- You have objected to the processing of personal data and you believe that, when your objection is assessed, it will be established that in the particular situation your interest outweighs our interest in processing the personal data

- The personal data has been processed unlawfully

- An obligation to erase the data is laid down by a specific legal regulation

- The personal data concerns children under the age of 16

Restriction of Processing

If (a) you dispute the accuracy of your personal data, (b) your personal data is being processed unlawfully, (c) we no longer need your personal data for the purposes of processing but you need it for the establishment, exercise or defence of legal claims, or if you have (d) objected as described in the previous section, you have the right to have the processing of your personal data restricted.

In such a case, we may process your personal data only with your consent (except for the storage or backup of the personal data concerned).

Submitting a Complaint

If you believe that we are processing your personal data unlawfully, you also have the right to lodge a complaint with the competent supervisory authority. The lead supervisory authority responsible for personal data processing matters is the Czech Office for Personal Data Protection.
